Dude, If you want to get the visa, you should be an expert in US immigration law by now. Do some search on the web, there is plenty of info about visas. And to answer your question: only employer can get you an H1B. As far as TN is concerned, I'm not canadian, so I dunno much, but I think you can get it when you cross the border, but the job offer is still required.
